PROMOTION DESCRIPTION
The World Poker Tour Invitational Sweepstakes (the "Sweepstakes") is intended for viewing and participation only in the United States ("U.S.") and shall be construed according to, and governed exclusively by, U.S. law. Do not participate in the Sweepstakes if you are not a legal resident of, and physically located in, the United States at the time of entry. The Sweepstakes starts at 12:01 am Eastern Standard Time (EST) on February 1, 2004 and ends at 11:59 pm EST on February 10, 2004 ("Entry Period"). By participating in the Sweepstakes, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of World Poker Tour, LLC ("Sponsor"), which shall be final and binding in all respects.
ELIGIBILITY
This Sweepstakes is open only to individuals who are (i) legal residents of the U.S., located in the 48 continental United States at the time of entry, and (ii) age 21 years of age or older at the time of entry. Employees, officers and directors of Sponsor, Lakes Entertainment, Inc., Travel Channel, Genex, and each of their respective parent companies, subsidiaries, affiliates, and advertising and promotion agencies (collectively, the "Promotion Entities"), as well as the immediate family members and/or those persons living in the same households of each are not eligible to enter or win this Sweepstakes. This Sweepstakes is void where prohibited.
HOW TO ENTER THE SWEEPSTAKES
During the Entry Period, you may enter by going to www.worldpokertour.com (the "Website") and completing the entry form with your full name, mailing address (including zip code), telephone number, email address and age. You may also be asked to answer optional questions, however they need not be answered in order to be eligible for the Sweepstakes. Click "Submit Entry" and you will automatically be entered into the Sweepstakes. Except as otherwise contemplated in these Official Rules, information collected in connection with the Sweepstakes will be used in accordance with the Website's privacy policy. All entries must be received by 11:59 pm EST on February 10, 2004. The Website's clock will be the official time keeper for this Sweepstakes. Limit one entry per person or email address will be accepted.
All required information must be completed to enter. Incomplete entries will be disqualified. Proof of entering information at the Website is not considered proof of delivery or receipt. Entrants must provide a valid email address to be eligible. In the event of a dispute regarding the individual who actually submitted an on-line entry, the entry will be deemed submitted by the authorized account holder of the email address supplied at the time of entry. "Authorized account holder" is defined as the natural person to whom the applicable email address has been assigned by the Internet Access Provider, online service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the address submitted. The potential winner may be required to provide Sponsor with proof that he/she is the authorized account holder of the email address associated with the winning entry. If a dispute cannot be resolved, the entry will be deemed ineligible. The Promotion Entities shall not be responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error which may occur in the processing of the entries in the Sweepstakes. The Promotion Entities assume no responsibility for any error, omission, interruption, deletion, theft or destruction, or unauthorized access to, or alteration of, entries.
All entries become the property of the Sponsor and none will be returned. False and/or deceptive entries or acts shall render entrants ineligible. Entry must be made by the entrant only at the authorized Website address of http://www.worldpokertour.com.
DRAWING
Five winners will be randomly selected from all eligible entries received throughout the Entry Period. The random drawing is currently scheduled to be conducted no later than February 12, 2004 by Sponsor, using methods within its sole discretion. Winners will be notified within forty-eight (48) hours after drawing date via email and/or telephone. Sponsor shall have no liability for any winner notification that is lost, intercepted or not received by the potential winner for any reason. If, despite reasonable efforts, a winner does not respond within five (5) days of the first notification attempt, or if the prize or prize notification is returned as declined, unclaimed or undeliverable to such potential winner, such potential winner will forfeit his or her prize and an alternate winner may be selected. If any potential winner is found to be ineligible, or if he or she has not complied with these Official Rules, such potential winner will be disqualified and an alternate winner may be selected. If Sponsor so elects, the Grand Prize winner will be required to submit to a confidential background check to confirm eligibility and help ensure that the use of such person in advertising or publicity for the Sweepstakes or the WPT Invitational will not bring Sponsor into public disrepute, contempt, scandal or ridicule or reflect unfavorably on the WPT Invitational or Sponsor as determined by Sponsor in its sole discretion.
PRIZE/ODDS
Five (5) Grand Prize winners will each receive an invitation to play in, and a trip to, the World Poker Tour Invitational (the "WPT Invitational") scheduled to be held on February 25-26, 2004 at the Commerce Casino in Commerce, California. At the WPT Invitational, the Grand Prize winner will have the opportunity to play in the WPT Invitational and advance to subsequent rounds, subject to the same rules and regulations that apply to all other players at the WPT Invitational. Each trip includes a round trip coach-class ticket to Los Angeles International Airport from the major, continental U.S. gateway city airport closest to winner's home, two nights lodging and ground transportation once in Los Angeles. The approximate retail value of each Prize Package is $1,000. Actual value of each Grand Prize depends upon the point of departure. In the event the closest airport to a Grand Prize winner's home is in the Los Angeles metropolitan area, prize will not include air transportation from Grand Prize winner's residence to Los Angeles and no other substitution or compensation will be provided in lieu thereof. Airfare does not include government taxes, Passenger Facility Charge or September 11th Security Fee. Ground transportation, travel insurance, tax, gratuities, personal expenses and all meals, gratuities, transfers and other expenses not specified herein are the sole responsibility of the winner. Travel subject to availability and confirmation of reservations. Potential winner must possess all required travel documents. Sponsor reserves the right to structure travel route in its sole discretion. Changes not permitted after ticket issue. Air tickets are non-refundable/non-transferable and are not valid for upgrades and/or frequent flyer miles. All tickets are subject to the vagaries of flight variation, work stoppages, and schedule or route changes. The Grand Prizes are non-assignable and non-transferable. No cash alternative or prize substitutions will be allowed except that Sponsor retains the right to substitute a prize of comparable or greater value (or at Sponsor's election, the cash value of the applicable prize) in the event a stated prize is unavailable, in whole or in part, for any reason. Trip must be taken during the WPT Invitational on the dates specified or the Grand Prize will be forfeited. If a Grand Prize winner does not have the opportunity to participate in the WPT Invitational due to scheduling conflicts, cancellations, postponement, an event of force majeure, or for any other reason, then the remaining components of the Grand Prize shall constitute full satisfaction of Sponsor's prize obligation to the Grand Prize winner, and no other or additional compensation will be awarded. Odds of winning depend on the number of eligible entries received during the Entry Period.
GENERAL CONDITIONS
This Sweepstakes is governed by the laws of the United States. All federal, state and local laws and regulations apply. All taxes and any other fees or costs associated with a prize are the sole responsibility of the respective winner. The Grand Prize winner will be required to execute and return the same Release form that all other players in the WPT Invitational are required to sign prior to play, along with an Affidavit of Eligibility/Liability Release and (where legal) a Publicity Release within three (3) days of prize notification, or the Grand Prize will be forfeited in its entirety and an alternate winner may be selected. Sponsor reserves the right in its sole discretion to disqualify (from participating in the Sweepstakes and/or the WPT Invitational) any individual who is found to be tampering with the entry process or the operation of the Sweepstakes or the Website, to be acting in violation of these Official Rules, or to be acting in an unsportsman-like or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Sweepstakes or the WPT Invitational, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law.
GENERAL RELEASE / FORCE MAJEURE
By participating in the Sweepstakes, each entrant releases and agrees to hold the Promotion Entities harmless from and against any and all liability, loss, damages or injuries of any kind sustained in connection with their participation in the Sweepstakes, or from their acceptance, receipt, possession and/or use or misuse of any prize, or for any typographical or other error in the printing, offering or announcement of any prize. Entrants further acknowledge that said parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, full or limited, express or implied, in fact or in law, relative to any prize, including but not limited to its quality or fitness for a particular purpose. By accepting a prize, each winner agrees to the use of his/her name, photograph and/or likeness by Sponsor, or any party authorized by Sponsor, for advertising and promotional purposes in any and all media without additional compensation. The Promotion Entities assume no responsibility for computer system, phone line, hardware, software or program malfunctions or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature. If, for any reason, the Sweepstakes is not capable of running as planned, including, due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor reserves the right in its sole discretion to cancel, terminate, modify, suspend or extend the Sweepstakes and, in the event of cancellation or termination, select winners from among all eligible, non-suspect entries received prior to event giving rise to the cancellation/termination. The Promotion Entities are not responsible for any damage to an entrant's system which is occasioned by accessing the Website, participating in this Sweepstakes or by downloading any information necessary to participate in the Sweepstakes. Any attempt by an entrant or any other individual to deliberately damage the Website or undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to disqualify the applicable individual and seek damages and other remedies from any such person to the fullest extent permitted by law. If any provisions of these Official Rules are determined to be invalid or unenforceable, such determination shall not affect the validity or enforceability of any other provision. These Official Rules cannot be modified or amended in any way except in a written document issued in accordance with law by a duly authorized representative of Sponsor.
GOVERNING LAW/JURISDICTION
ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR SPONSOR IN CONNECTION WITH THE SWEEPSTAKES SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE INTERNAL LAWS OF THE STATE OF CALIFORNIA WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OF CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE'S LAWS.
ARBITRATION PROVISION
By participating in this Sweepstakes, each participant agrees that: (1) Any claim, dispute, or controversy arising out of, relating to, or connected in any way with the Sweepstakes or the awarding or redemption of prizes will be resolved exclusively by final and binding arbitration conducted pursuant to the AAA's Procedures for Consumer-Related Disputes in conjunction with the AAA's Commercial Arbitration Rules (if and as applicable depending on the amount in controversy); (2) The arbitration shall be held at the AAA regional office nearest the entrant; (3) The arbitrator's decision shall be controlled by the terms and conditions of these Official Rules and any of the other agreements referenced herein that the applicable participant may have entered into in connection with the Sweepstakes; (4) There shall be no authority for any claims to be arbitrated on a class or representative basis; and (5) The arbitrator shall not have the power to award punitive damages against the participant or Sponsor. In addition, if the participant is able to demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, Sponsor will pay as much of the participant filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive.
WINNERS' LIST/OFFICIAL RULES
The names of the prize winners may be obtained after February 26, 2004 and no later than May 1, 2004 by sending a self-addressed stamped envelope to: "World Poker Tour Invitational Sweepstakes/ Winner's List", c/o World Poker Tour, LLC, 1041 North Formosa Avenue, Formosa Building, Suite 99, West Hollywood, California, 90046.
